Evelyn Muhlhan, CNM, has been assisting families in Maryland have the birth of their dreams since 1998.
On October 7, 2011 Evelyn received a Letter of Suspension from the Maryland Board of Nursing which prevents her from practicing as an Advance Nurse Practitioner, Certified Nurse-Midwife. The Board of Nursing stated that due to five complaints since 2008, she needed to prove that she was a safe practitioner.
There are several problems with the way the Board of Nursing has treated Evelyn. The first, and most severe, is the fact that they suspended her license before proof has been established. One of our rights as an American is that we are deemed innocent until proven guilty. This drastic act does not allow that right to Evelyn. The Board of Nursing has stripped Evelyn of her ability to serve women in any capacity. They did not just suspend her CNM license, they also suspended her Registered Nurse (RN) license, thus completely taking away her ability to work or make a living.
Secondly, none of these complaints came from one of Evelyn’s clients or a client’s family. The complaints were filed by hospital physicians after a client was transported to the hospital. In fact, three of the five complaints came from the same hospital. This particular hospital's Director of OB/GYN has stated to Evelyn that he believes that Midwives "romanticize birth" and "we are more concerned about the safety of mother and baby". He obviously was implying that midwives are not concerned with the safety of mother and baby, which we all know to be untrue.
Due to client confidentiality, we cannot discuss the issues surrounding the hospital transfers, but we can say that every one of these transports was medically appropriate and the clients’ care was excellent in each case.
Evelyn is looking forward to her hearing before the Board of Nurses so that she has the chance to present the evidence that will show that not only is she a safe and skilled practitioner, but also that she educates her clients, allows her clients to be consumers and to make their own health care choices, and advocates for her clients to allow them to get the birth that they want.
We are asking that you would help Evelyn fight this legal battle. Evelyn has devoted 26 years of her life to being "with woman". She has been there for all of us, let's be there for her.
Because Evelyn is not permitted to work, she has no income. In order to fight this battle, she needs to fund her lawyers. We will be hosting some fundraisers in the next few weeks and months. Right now, we are asking for donations to gather some immediate funds to help this legal battle.
